Welcome to Planet Matters

These Terms and Conditions (“Terms”) govern your use of Planet Matters services, including our mobile app, website, and related tools and features (collectively, the “Service”). Planet Matters GmbH (“we,” “us,” or “our”) owns and operates the Service. By using the Service, you agree to these Terms. If you do not agree, you must discontinue use of the Service.

1. Introduction

Planet Matters GmbH, registered in Austria at Göriacherstraße 28, 9220 Velden, Austria, provides the Service, including the Planet Matters mobile app (“App”) and website [www.planetmatters.net] (“Site”).

2. Eligibility

Users must be at least 18 years old to use the App. By accessing or using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

Users may need to create an account. You agree to:

  • Provide accurate registration information.
  • Safeguard login credentials.
  • Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations, suspicious activity, or at our discretion, without prior notice or explanation.

4. Use of the Service

You are granted a limited, non-exclusive license to use the Service for personal, non-commercial purposes. You may not:

  • Reverse engineer or modify the Service.
  • Use the Service for unlawful purposes.
  • Interfere with the Service or networks.

We may modify, suspend, or discontinue the Service at any time.

5. User-Generated Content

You may submit photos, comments, and other content (“User-Generated Content”). By doing so, you confirm:

  • You own the content or have the necessary permissions.
  • The content does not violate third-party rights or contain offensive material.

We reserve the right to remove inappropriate content.

6. Litter Collection and Photo Submission

By submitting photos of litter collection:

  • You confirm the photos are original.
  • You grant us a license to use the photos.
  • The photos must not contain offensive or inappropriate content.

We reserve the right to remove photos that violate these terms.

7. Earning Points and Redeeming Rewards

You may earn points (“Planet Coins”) for verified litter collection. Planet Coins can be redeemed for rewards but have no cash value and cannot be exchanged for cash. We do not guarantee the availability of rewards.

  • Reward Redemption: Once redeemed, codes will be sent via email for use with partner companies.
  • Ensure your email is correct; we are not responsible for errors or expired codes.
  • Right to Cancel: We reserve the right to cancel or revoke any Planet Coins, rewards, or accounts at any time, with or without explanation.

8. Termination and Suspension

We may suspend or terminate your account for violations of these Terms. Upon termination, you must discontinue use and delete the App.

9. Intellectual Property

The Service’s content, including the App and Site, is owned by us or our licensors. You may not reproduce or distribute it without permission.

10. Website Use

You may only use the content on our website for personal, non-commercial purposes. Third-party links are for convenience, and we do not assume responsibility for them.

11. Disclaimer of Warranties

The Service is provided “as is,” without warranties of any kind. We do not warrant uninterrupted access or error-free performance.

12. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service or violation of these Terms.

14. Dispute Resolution

Disputes will be resolved through mediation in Austria. If mediation fails, the dispute will be subject to the courts in Austria.

15. Changes to the Terms

We may update these Terms, with changes reflected in the “Last Updated” date. Continued use constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by Austrian law, with disputes resolved in Austrian courts.
